Hazardous Chemical Environmental Management Registration Process Will be Replaced by Notification

On 19 February 2016, “Decision about cancelling additional 152 administrative approvals” was published by the State Council. Hazardous chemical environmental management registration is included in these 152 Administrative Approvals, and will be replaced by notification. However, new version of Measures for Environmental Administrative Registration of Hazardous Chemical (MEP Order 22) hasn’t been issued yet, so the new notification procedure hasn’t been published.

The cancelled administrative approvals involve in various industries, for instance, advertisement, education, food, architecture, cosmetic, chemical and so forth. And 2 administrative approvals closely related to chemical industry: environmental management registration certification for hazardous chemical manufacture and usage; prequalification of environmental management registration for toxic chemical import and export at the Ministry of Environmental Protection. The Item 21 in the appendix of this “Decision” is consistent with “Measures for Environmental Administration Registration of Hazardous Chemicals (for public comment)”, also known as MEP Order No. 22, which released at the second half year of 2015. The both documents regulated that the environmental management registration for hazardous chemical manufacture and usage will be replaced by the environmental management notification. The notification of hazard chemical will be publicized instead of issuing registration certification. There were some problems when carried out the “Measures”, for example, unclear property of registration may result in chaos enforcement; the accountability risk for local environmental protection departments to issuing registration certification is high; not accord with “Simplification” requirements; registration checking technique is difficult, local department cannot handle it, etc.. The new method of Hazardous Chemical Environmental Management may solve or remit above problems. As of today, the revised MEP Order No. 22 hasn’t been published.

The Item 130 in the appendix of the “Decision” cancels “Prequalification of the environmental management registration for toxic chemical import and export to the Ministry of Environmental Protection”. MEP Notice 113 is revising, and expert estimates that the procedure of registration and relevant “List of toxic chemicals severely restricted to be imported into or exported from the People Republic of China” may be modified. So far, the new version Notice 113 for public comment hasn’t been released.
