Since the promulgation of the Cosmetics Supervision and Administration Regulations (CSAR) on June 29, 2020, a series of supporting documents related to the registration and filing of new cosmetic ingredients, including the Measures for the Administration of Cosmetic Registration and Filing, Provisions on the Administration of New Cosmetic Ingredients Registration and Filing Data, and Technical Guidelines for Cosmetics Safety Assessment, have been introduced. Between May 1, 2021 and November 29, 2022, after the CSAR implemented, a total of 45 new cosmetic ingredients have passed the new cosmetic ingredient filing.
Under the Regulations Concerning the Hygiene Supervision over Cosmetics (now abolished), all new ingredients were subject to approval with the same standard. As a result of this, it is quite difficult to grasp the criteria for technical review and only a small number of new cosmetic ingredients have been approved - from 2004 to May 1, 2021, only 14 new cosmetic ingredients were approved for filing.
It can be seen that under the CSAR, the risk-based management mode has greatly accelerated the filing process for new ingredients with less risks. The set of a 3-year monitoring period also adjusts the regulatory model from “government taking full responsibility for cosmetics safety” to the registrants independently undertaking the safety monitoring obligations of new cosmetic ingredients, which also meets the needs of enterprises to protect technological innovation. This adjustment can also fulfill enterprises’ requirements on the protection of technical innovation.
